1. General Use and Account Security
You must be at least 18 years old or operating as a registered business entity to use our services. When registering an account, you agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and API keys. BulkieMsg is not liable for any unauthorized access to your account.
2. Permitted and Prohibited Messaging
BulkieMsg strictly prohibits the use of our infrastructure to send spam, unsolicited promotional messages, phishing campaigns, or any content that violates the laws of the Republic of Ghana or international telecommunications standards. When using our platform:
- You must have explicit, verifiable consent from contacts before sending them marketing messages.
- You may not send messages that contain fraudulent claims, malware, or offensive material.
- Sender IDs are subject to approval and must accurately represent your business. Spoofing or impersonating governmental or financial institutions is strictly prohibited.
Failure to comply with these rules will result in immediate account suspension and potential legal action.
3. Payments, Credits, and Refunds
All messaging credits and data bundle purchases are processed securely via our payment gateways. All sales are final. Messaging credits (SMS/WhatsApp) purchased on our platform do not expire, but they are strictly non-refundable and non-transferable.
For BulkieBundles data purchases, if a direct top-up fails due to network downtime, the system will automatically process a refund to your internal wallet. You may use this wallet balance for future purchases.
4. Uptime and Service Reliability
We strive to maintain 99.9% uptime for our core messaging delivery and API endpoints. However, BulkieMsg relies on downstream telecommunications networks. We are not liable for delays, delivery failures, or downtime originating from mobile network operators (MNOs) or Meta platforms (WhatsApp).
5. Data Privacy and Security
Your data is yours. We implement industry-standard encryption to protect your contact lists, message logs, and payment details. We do not sell or lease your customer data to third parties. For a detailed breakdown of how we handle user data, please refer to our Privacy Policy.
6. AI Generation Tool Usage
BulkieMsg provides an AI Generative Assistant to help you compose messages. You acknowledge that AI-generated content is provided "as is" without warranty. It is your responsibility to review, edit, and verify the accuracy of all AI-generated content before broadcasting it to your customers.
7. Modifications to Terms
BulkieMsg reserves the right to modify these Terms and Conditions at any time. Significant changes will be communicated via email or dashboard notifications. Continued use of the platform after changes have been published constitutes acceptance of the new terms.
